TERMS & CONDITIONS. This agreement (the “Terms & Conditions”) is a legally binding agreement between Kenwood Vineyards, its affiliates, and its and their respective parents and subsidiaries (the “Company”, “We”, “Our”, or “Us”), and You, the Member. These Terms & Conditions apply to your membership in the Kenwood Vineyards Wine Club.
We may, at any time, revise and update these Terms & Conditions, in our sole discretion without notice. All changes are effective immediately when we post them and apply to all access to use of the Website and Membership Program thereafter. Your continued use and membership following the posting of such revised Terms & Conditions means that You accept and agree to the changes.
ELIGIBILITY. You represent and warrant that you are twenty-one (21) years of age or older. Wine shipments must be signed for upon delivery by an adult 21 years of age or older. Membership is available to consumers in AK, AZ, CA, CO, CT, DC, FL, GA, HI, IA, ID, IL, KS, MA, MD, ME, MI, MN, MO, MT, NC, ND, NE, NH, NM, NV, NY, OR, PA, SC, TN, TX, VA, VT, WA, WI, WV and WY.
CLUB SELECTION MEMBERSHIP
HOW IT WORKS. When you join Kenwood Vineyards Wine Club, you agree to a minimum of three (3) Club Selections. When you sign up to be a member, you will receive an introductory email and welcome letter from us where we will discuss the benefits of your membership.
Based on your membership level, you will receive a Club Selection that consists of between four (4) and six (6) bottles and arrives four (4) times per calendar year. As a member, each Club Selection will be shipped to you, or you may choose to pick it up at the winery. You may change your shipping or pickup option at any time by contacting us before your card has been charged. Shipment rates are based on your location and may change based on current market rates.
Approximately two weeks before the first of the month of your Club Selection, you will receive an email that notifies you of your upcoming Club Selection. Up until your credit card has been charged, you may adjust and customize your Club Selection within the options available. Once your card has been charged, we can no longer make changes to your Club Selection. No refunds or returns are permitted. If there is an issue with the quality of any bottle within your Club Selection, we may, in our own discretion, send a comparable replacement or other makegood. If any problems arise with your order, or with the shipping address or the payment method associated with your membership, we may notify you via email using the email address associated with your membership. It is important that you keep your information current with an accurate email address that you regularly check. If problems arise with your order that we cannot resolve, your order may be cancelled and we may not be able to deliver future shipments until the problem has been resolved.

SHIPPING AND PICKUP OPTIONS. At the time of registration, you will elect whether you would like to have your Club Selection shipped to you, or if you would prefer to pick up your Club Selection at the winery.
If you choose to pick up at the winery, you must pick it up within 60 days, or we will ship it to you at the standard rate. After 60 days, your wines may be subject to change based on availability, in which case we will notify you and attempt to find a materially similar substitute.
CHANGE OF ADDRESS. It is your obligation to notify Kenwood Vineyards of address changes before your wines are shipped. Unreported changes of address, non-delivery and forwarding of packages resulting in additional shipping fees will be charged to you.
Refused club shipments are subject to shipping fees.
CANCELLATION. You may cancel your membership at any time online by logging into your membership page. You can also contact us by email to cancel your membership (contact Information below). Your cancellation will be effective as of the date you contact us. You must cancel before you have been charged for your next shipment in order to avoid being charged for that shipment.
Products are for your own personal, non-commercial use only. You may not purchase products or membership for further distribution or resale or for any other commercial or business purpose. The Kenwood Vineyards Wine Club Membership and all rights and privileges conferred therewith are personal to you and non-transferable. We reserve the right to cancel/terminate any user’s account and membership at any time in our sole discretion, including for any violation of these Terms & Conditions, violation of any laws, or for any action of a user that we deem to be contrary to the tenets of Kenwood Vineyards.
We reserve the right, at our sole discretion, to cancel any individual order, the Kenwood Vineyards Wine Club, for any reason, at any time. We reserve the right to change any benefits offered through the Kenwood Vineyard Wine Club Membership, including discounts and other promotional offers, at any time in our sole discretion. Memberships that skip or pause Club Selections may be subject to cancellation or suspension of benefits.
